06.05.2022 S/L No.8 KS

C.R.R. 38 of 2015

Naba Kumar Sikdar

-Vs.-

Subhasis Basu Sarbadhikari

Mr. Ganesh N. Jagodia Ms. Nitu Singh .....For the Opposite Party

The revisional application is listed today for hearing.

None appears on behalf of the petitioner.

Mr. Ganesh N. Jagodia, learned advocate for the opposite party is

present.

It appears from the record that on 28.03.2022 Mr. Somdeb Ash, learned

advocate had appeared for the petitioner, but no Vakalatnama was filed by

him.

This revisional application under Section 482 of the Code of Criminal

Procedure has been filed by the petitioner assailing the judgment and order

dated 29.11.2014 passed by the Learned Additional District & Sessions Judge,

1st Fast Track Court, in Calcutta in connection with Criminal revision No.20 of

2014 thereby affirming the judgment and order dated 23.12.2013 passed by

Learned Metropolitan Magistrate, 13 th Court, Calcutta in connection with C.

Case No.873 of 2010 under Section 138 of the Negotiable Instruments Act,

whereby the petitioner was sentenced to undergo simple imprisonment for one

month and also to pay compensation of Rs.45,000/- only within 60 days, in

default to suffer simple imprisonment for one month. It appears from the

record that petitioner has deposited Rs.15,000/- before the Learned Trial Court

in compliance with earlier order passed by this Court on 14.01.2015.

Since, none appears for the petitioner, the application is taken up for

consideration.

Perused the impugned judgment passed in Criminal Revision No.20 of

2014.

Considered.

I find no infirmity in the said judgment passed by the Learned Sessions

Judge. Therefore, there is no reason to interfere with the said judgment.

Moreover, the petitioner is also not diligent in representing his case which, is

pending for several years.

Under such circumstances, the revisional application is dismissed for

default and is disposed of. There is no interim order as on date.

Let a copy of this order be communicated to Learned Additional

District & Sessions Judge, 1st Fast Track Court, Calcutta for information.
