This revisional application is arising out of a judgment and order dated September 7, 2009, passed by the learned Sessions Judge, Darjeeling in Criminal Appeal No.02 of 2009 affirming the judgment and order dated January 30, 2009, passed by the learned Judicial Magistrate, 2nd Court, Siliguri convicting the petitioner under Section 138 of the Negotiable Instruments Act, 1881, sentencing him to suffer simple imprisonment of one year and to pay compensation of Rs.2 lakh.
It has been submitted by the learned advocate for the petitioner that his client is ready and willing to settle the matter and as a last chance, an opportunity should be given to the petitioner to resolve the dispute between the parties by an amicable settlement.
Accordingly, this matter is directed to be placed before the Mediation and Conciliation Committee, High Court, Calcutta to explore the possibility of settlement between the parties.
