The revisional application is listed today for hearing.

The petitioner in his application under Sections 401 and

482 of the Code of Criminal Procedure, 1973 has assailed the

order dated 4.8.2014 passed by the learned Additional District

and Sessions Judge, Bishnupur, Bankura in sessions case no.

7(6)2012 under Section 302/201/120B of the Indian Penal Code

wherein the petitioner prayed for defreezing of his SB Account

no. 10309 with United Bank of India, Katulpur Branch, Bankura

was rejected.

During pendency of this revisional application, Sessions

case no. 7(6)12 was finally disposed of on 16.12.2016 resulting

in conviction of the accused/petitioner, Nabakumar Adhikary for

the offence under Section 302/201/120B/34 of the Indian Penal

Code and Section 25 and 27 of the Arms Act.

The petitioner has preferred Criminal Appeal bearing no.

46 of 2017. It is submitted on behalf of the petitioner that the

Bank account has been frozened though it has no reference in

the judgment. Since the case has already been disposed of and

an appeal is pending against the judgment of conviction and

sentence, any matter related to the subject of case should be

considered by the court before which Criminal Appeal is now

pending.

Under such circumstances, let this revisional application

be released from the list.

Let the matter be placed before the Hon'ble The Chief

Justice, High Court at Calcutta, for appropriate direction.
