The Assistant Director of Pension, Provident

Fund and Group Insurance, West Bengal, is

present in Court. A Pension Payment Order in

favour of the petitioner, in terms of the directions

of a Co-ordinate bench of this Court dated May

11, 2021, has been produced. There is no

explanation as to why the pension payment to the

petitioner was not issued or as to why

clarifications were not called from the petitioner

earlier either.

However, since the unmarried daughters

have been allowed pension by reason of a

judgment of a Co-ordinate bench of this Court

reported in 2018 (2) WBLR (Cal) 138, passed in

WP 23466 (W) of 2017, in the case of Bharati

Hazra Vs. State of West Bengal and others.

This Court is of the view that the petitioner would

be entitled to interest from December, 2020, @ 7%

per annum.

It is expected that the pension will be

released to the petitioner, within a period of one

month from date. All arrears, as directed

hereinabove, shall be paid to the petitioner, within

a period of two months from date, positively and

mandatorily.

With the aforesaid observations, the writ

petition shall stand disposed of.

The personal presence of the Assistant

Director of Pension, Provident Fund and Group

Insurance, West Bengal, is dispensed with.

It is expected that delay in respect of

pension matters is avoided completely and the

conduct complained of against the office of the

Pension and Provident Fund Director, is not

repeated.

There shall be no order as to costs.

All parties shall act on the server copy of

this order duly downloaded from the official

website of this Court.
