Petitioners have raised the grievance in respect of the

recruitment process which has been adopted for the post

of Data Entry Operator, Contractual Consultant and

Contractual Junior Consultant, etc. in different Bangla

Sahayak Kendra in West Bengal.

The submission of learned counsel for the petitioners

is that no paper publication inviting application from the

eligible candidates has been made and only the online

application has been invited and that no selection criteria

has been fixed, no written test has been provided and the

recruitment is sought to be made only on the basis of

interview.

Further submission of learned counsel for the

petitioners is that the respondents are adopting a policy

of pick and choose. In support of his submission, learned

counsel for the petitioners has placed reliance upon the

WPA (P) 328 of 2022

judgment of the Hon'ble Supreme Court in the matter of

State of Orissa and another vs. Mamata Mahanti

reported in (2011) 3 SCC 436 and in the matter of Arun

Tewari and others vs. Zila Mansavi Shikshak Sangh

and others report in AIR 1998 SC 331 and other

judgments mentioned in paragraph 16 of the writ

petition.

Learned counsel appearing for the main contesting

respondent, respondent No.4 seeks three weeks time to

file affidavit-in-opposition, thereafter affidavit-in-reply, if

any, be filed within one week.
