This is an appeal against the judgment and order dated April 25, 2006 passed by the Judicial Magistrate, Fourth Court, Hooghly in CR Case No. 224 of 1997 acquitting the accused/opposite party for offence punishable under Section 138 of the N.I. Act.
Since the appellant is not coming before this Court in spite of several opportunity given, Mr. Mirza Firoz Ahmed Begg, learned Advocate, who is present in Court today, is appointed as Amicus Curie to represent the appellant.
It is also seen that the learned lawyers who represented the State on earlier occasion is found absent. Accordingly, Mr. Ashok Das, a State empanelled lawyer, who is also present in Court today, is requested to represent the State in the instant case. Let his appointment be regularized in this case.
Considering the fact that this is an appeal of 2010 against an order of acquittal, the matter is taken up for hearing.
Heard both the lawyers who concluded their argument. CAV.
