Versus
Union of India & Ors
Mr. Uttam Banerjee,
Mr. Arunesh Pathak,
Mr. Aniruddha Singha Roy
... For the petitioner.
Despite service none appears for the respondents.
Let the affidavit-of-service filed by the petitioner in
Court today be kept with the record.
The petitioner seeks admission in M.B.B.S. Course
on the strength of his performance in National Eligibility
cum Entrance Test (UG)-2021 against the available
vacancies.
In terms of the judgment, reported at (2016) 11 SCC
225 (Ashish Ranjan v. Union of India), the last date for
admission in the medical course has been fixed on 31 st
August of that particular academic year. However, by a
subsequent order dated May 9, 2022 passed in that case,
the Hon'ble Supreme Court had extended the time till
April 28, 2022, keeping in mind the pandemic situation.
The petitioner seeks admission beyond the
scheduled time fixed by the Hon'ble Supreme Court. The
petitioner cannot be admitted to a medical course at this
juncture.
I do not find any merit in this writ petition.
Accordingly, WPA 9352 of 2022 is dismissed.
Let urgent photostat certified copies of this order, if
applied for be supplied to the parties upon compliance
with all necessary formalities.
