Heard Mr. Debarabra Saha Roy, learned counsel for
the appellant.
Inspite of sufficient notice on the last occasion
regarding posting of the appeal today for final disposal,
Mr. Sushovan Sengupta, learned counsel for the State is
absent on call.
Mr. Saha Roy has placed reliance on the judgment
rendered on 19th February, 2014 in the case of Samar
Das -vs.- State of West Bengal & Ors. [W.P. 34215 (W) of
2013] to substantiate his case and also relied on some
judgments of the Hon'ble Supreme Court on the law of
precedent and executive action.
Mr. Saha Roy is directed to file written notes of
argument by 12th July, 2022. A copy of the written notes
of argument be served upon Mr. Sushovan Sengupta,
learned counsel for the State and if he wants to file any
written notes of argument on behalf of the State, may file
by 12th July, 2022.
ACO List this matter on 12th July, 2022 for submission
of written notes of arguments.
It is made clear that no further scope of hearing
shall be given to any of the parties.
