The Court: The affidavit-in-opposition on behalf of the respondent

nos. 3 and 4 filed in Court today is taken on record. The said affidavit as

submitted by respondent nos. 3 and 4 was served on the petitioner's

Advocate on 13th December, 2021. No reply has been filed on behalf of

the petitioner till date. It is submitted by the petitioner that the affidavit

could not be made ready as the Advocate on record of the petitioner is

unwell for last couple of days. The petitioner, therefore, seeks seven

days extension of time to file the reply. The prayer for extension is

vehemently opposed by the respondent nos. 3 and 4 as according to the

said respondents the affidavit-in-opposition was served as far back as on

13th December, 2021 and till date no reply has been filed. The delay in

filing the reply is according to the said respondents is a dilatory tactics

on behalf of the petitioner since the petitioner is enjoying an interim

order.

Considering the submissions made by the parties only for the ends

of justice as and by way of a last chance the petitioner is permitted to file

its affidavit by 17th January, 2022.

Let this matter appear on 19th January, 2022. The parties shall

exchange the list of judgments to be relied upon by them and file their

respective compilation of judgments before this Court by 17th January,

2022.
