It appears from the office report that the Lower Court

record was received by this Court and during examination it

was found that the Lower Court does not contain the

connected Lower Court record of the 2nd Court of the learned

Judicial Magistrate at Sealdah. The judgment passed by the

learned Judicial Magistrate, 2nd Court at Sealdah and all the

exhibits marked during trial were also not incorporated in

the record sent by the learned Additional Sessions Judge, 1 st

Court at Sealdah.

Accordingly, the learned Additional Sessions Judge, 1 st

Court at Sealdah is directed to produce the record of the

learned Judicial Magistrate, 2nd Court at Sealdah in

connection with the instant appeal.

It is recorded that the number of the case record

disposed of by the learned Judicial Magistrate, 2 nd Court at

Sealdah on 16th April, 2015 is G.R. Case No. 760 of 2005

arising out of Chitpur Police Station Case No.68 of 2005

dated 5th May, 2005 under Sections 408/468/506(II) of the

Indian Penal Code.

Let a copy of this order be sent to the learned

Additional Sessions Judge, 1st Court at Sealdah for

information and compliance within three weeks from the

date of communication of this order.
