Learned counsel appearing on behalf of the

respondents no. 4 and 5 draws the attention of the Court

to a judgment of the Hon'ble Division Bench of this Court

passed in MAT No. 31 of 2022 with IA:CAN No. 1 of 2022

passed on January 27, 2022 in an appeal directed against

a judgment and order of this Court dated January 05,

2022 in WPA No. 5538 of 2021. The said writ petition deals

with the issue which is identical to that of the present writ

petition.

It has been observed by the Hon'ble Division Bench

in the said judgment that the matter relates to Group-IX of

the Classification List and this Court has no determination

to deal with the matter.

In view of the above, let this matter go out of list with

liberty to mention before the appropriate Bench.
