The Court:- This is an application for execution of an award dated 11th
May, 2021. By the said award the judgment-debtors were directed to pay a sum
of Rs.16,43,175/- to the decree-holder. It is submitted on behalf of the decree-
holder that the said award has become final, binding and enforceable and there
is no challenge pending against the same. Significantly, in an earlier application
under 9 of the Arbitration and Conciliation Act, 1996 being AP No. 416 of 2021
this Court had passed an order of injunction in terms of prayer (b) of the Notice
of Motion insofar as the immovable properties of the judgment-debtor are
concerned.
In view of the fact that the award still remains unsatisfied till date.
There shall be an order in terms of prayers (a) and (e) of the Tabular
Statement.
The decree-holder is directed to forthwith effect service on the judgment-
debtor and file an Affidavit of Service on the returnable date.
It is made clear that in default of such filing of their Affidavit of Assets
appropriate orders would be passed against the judgment-debtor.
Let this matter appear on 21st March, 2022.
