The appellant is acquitted of the charge.

He be released forthwith from custody if his detention is not

required in any other case.

A copy of this order be immediately sent by the Department to

Superintendent, Berhampore Central Correctional Home, District -

Murshidabad.

The Secretary, High Court Legal Services Committee is directed

to do the needful to pay the fees in accordance with scale applicable

to category 'A' lawyer to Mr. Mukteswar Maity, learned amicus curiae

within a period of 15 days from the date of reopening.

The Department is further directed to send a copy of this order

to the Secretary, Calcutta High Court Legal Services Committee to do

the needful.
