We are admitting this second appeal on the
following substantial questions of law.
I. Whether the claim of the respondent to title
over a part of the suit property was in issue
before the learned courts below?
II. Whether and to what extent that issue was
determined by the said courts?
III. What is the impact of the impugned
judgment and order on Title Suit No. 893 of
2017, pending before learned Civil Judge
(Junior Division), 6th Court, Howrah?
Since the respondent has appeared, service of the
notice of appeal is dispensed with.
Transmission of lower court record is dispensed
with for the time being. We may call for those records if
required at the time of hearing of the appeal.
Advocate-on-record for the appellants will
prepare an informal paper book and file the same
in this Court by 31st January, 2023. A copy of the
paper book shall be served on the advocate-on-
record for the respondents at least seven days before
the date fixed for hearing of the appeal.
The application (CAN 1 of 2020) is disposed of.
List the appeal before the appropriate bench on
14th February, 2023, subject to its convenience.
