We admit the appeal.

For proper appreciation of the case of the parties

which was disposed of by the impugned judgment and

order of the learned court below, in our opinion, a

Special Officer should be appointed to ascertain the

number of tenants/occupiers, the area of occupation of

each tenant/occupier, the rent or occupation charges

being paid by each tenant/occupier, the person to

whom such rent or occupation charges are being paid

and file a report in this court by 4th January, 2023,

circulating copies thereof to all the parties.

We appoint Ms. Jyotsna Mukherjee advocate and

member of Bar Association (Mobile No.94331 46289) as

a Special Officer at an initial remuneration of

Rs.15,000/- to be borne by the appellant to carry out

the above work.

List the appeal and the application for further

consideration on 9th January, 2023.
