During pendency of the appeal, the parties filed an
application under Section 13B of the Hindu Marriage Act, 1955
for dissolution of marriage on mutual consent.
The learned Trial Court upon satisfied being recorded that
due procedure was adopted and there has been no collusion, fraud
and coercion, allowed the application for mutual divorce and
MAT Suit No. 235 of 2022 was decreed on mutual consent on 6 th
August, 2022.
The wife has already received her Stridhan articles along
with agreed amount of Rs.3,00,000/- towards her maintenance in
the form of a demand draft. In view thereof, the impugned order
and judgment is set aside.
We dispose of the appeal on the basis of the order passed by
the learned Additional District and Sessions Judge, Alipurduar on
6th August, 2022.
The photostat copy of the demand draft and the copy of the
order dated 6th August, 2022 are taken on record.
