AIR 2017 SC 5157 (National Insurance Co. Ltd. Vs. Pranay Sethi & Ors.) has

been cited to demonstrate the binding nature of precedence. On the other

hand, the respondents cited a judgment delivered by the Hon'ble Supreme

Court on 18th May, 2022 reported in 2022 SCC Online SC 641 (Rushibhai

Jagdishchandra Pathak Vs. Bhavnagar Municipal Corporation) to urge that

limitation point as applicable in civil suit is also applicable in case of money

claim made in a writ petition.
