This matter has been repeatedly adjourned on the grounds of non-
appearance of the respondent. None appears on behalf of the respondents nor is
any accommodation prayed for on his behalf.
As a last chance, the petitioner is directed to serve a Notice on the
Advocate appearing on behalf of the respondent as well as the respondent and
file an Affidavit of Service on the returnable date.
This is an application for judgment upon admission. The cause of action
arises out of money lent and advanced. It is submitted on behalf of the
petitioner that notwithstanding repeated demands, the respondent has refused
and neglected to pay any amount either on account of interest or principal.
It is made clear that in the absence of the respondent, appropriate orders
would be passed on the returnable date.
