The Court: This is an application for execution of an award dated 5 th July,

2018 as modified by the order dated 11 th July, 2018. The awarded amount is

approximately Rs.2.23 crores.

It is submitted on behalf of the judgment-debtor that an application under

Section 34 of the Arbitration and Conciliation Act, 1996 is pending before the

Hon'ble High Court at Bombay and because of the on going pandemic situation

the same cannot be taken up for hearing.

There is no stay of the award which is sought to be executed.

In these circumstances, the judgment-debtor is directed to file an affidavit

of assets in Form No. 16A of Appendix-E of the Code of Civil Procedure, 1908

on or before the returnable date.

Let the matter appear in the Monthly list of December, 2021.
