Laxmi Narayan Singh Versus Shriram City Union Fianance Limited & Anr.
The present revisional application has been preferred
against the judgment and order dated 27.02.2012 passed by the
learned Additional District and Sessions Judge, Fast Track Court-
VII, Bichar Bhawan, Calcutta in Criminal Appeal No.32 of 2009
wherein the appellate court was pleased to affirm the order of
conviction and sentence passed by the learned Magistrate, 10th
Court, Calcutta in connection with Case No.C/8479 of 2004 under
Section 138 of the Negotiable Instruments Act.
Today, when the matter has been called, none appears
on behalf of the petitioner.
Having regard to the fact that as the issue involves an
order of conviction and sentence, I am not inclined to interfere with
the merits of the case. However, the revisional application being
CRR 1809 of 2012 is dismissed for default.
Pending application, if any, is consequently disposed of.
Interim order, if any, is hereby vacated.
The learned Metropolitan Magistrate, 10th Court,
Calcutta would execute the order of conviction and sentence so
passed on 31.07.2010 in connection with Case No.C/8479 of 2004.
The Department is directed to communicate this order to
the learned Metropolitan Magistrate, 10th Court, Calcutta within a
period of seven days.
The learned Metropolitan Magistrate, 10th Court,
Calcutta is directed to act on the server copy of this order.
