The Court: This is an application for execution of an award dated 19 th
February, 2020. It is submitted on behalf of the decree-holder that the award
has become final, binding and enforceable. The award is for a sum in excess of
Rs.40 lakhs. None appears on behalf of the judgment debtors nor is any
accommodation prayed for on their behalf.
In view of the fact that the award remains unsatisfied, there will be an
order in terms of prayers (e) and (g) of the Tabular Statement.
The matter is made returnable in the Monthly List of December, 2021.
It is made clear that in default of filling of such affidavit of assets,
appropriate order for warrant of arrest would be issued against the judgment
debtors.
The decree-holder is directed to serve fresh notices on all the judgment
debtors and file an affidavit of service on the returnable date.
