Learned counsel appearing for the petitioner and

the Department have made their submissions. Besides

preliminary ground of maintainability taken on behalf

of the latter, several judgments of the Division Bench

have also been placed to show that the petitioner does

not have a case.

Since learned counsel appearing for the petitioner

seeks to take instructions on whether an earlier writ

petition filed before the court in W.P.6352(W) of 2017

by the same petitioner should proceeded with, list this

matter on 29th November, 2021, as prayed for.
