The second appeal tender is of year 2001. As

per report dated 16th January, 2007, the appeal is out of

time by 1063 days. Appellant nos.1 and 2 have not

executed the vokalatnama. A further reported defect is

difference in date of decree with date of judgment of lower

appellate Court. The last defect need not detain moving of

the appeal since rule 7 in order 20, Code of Civil Procedure

provides for date of decree to be the date when judgment

was pronounced. None appears on behalf of appellants.

Let notice be issued to the learned advocate,

enclosing copy of this order, for taking steps to remove the

defects as well as that the appeal will be listed in monthly

list of August, 2021. In event steps are not taken or

appellants continue to go unrepresented or either of the

above, the appeal is likely to be dismissed on adjourned

date or thereafter.
