Records reveal that by an order dated 1 st October, 2020 this

Court directed that the Lower Court Records should be called for

immediately at the expense of the petitioner/appellant and the

department was also directed to take steps to ensure that the

matter can be taken up and heard immediately.

Mr. Mukherjee, learned senior advocate appearing for the

petitioner/appellant submits that pursuant to such directions

special messenger cost was deposited.

Mr. Mukherjee further informs this Court that apart from the

petitioner/appellant herein there are four other convicts.

The department is directed to file a report as to whether the

Lower Court Records have arrived in Court and as to whether the

paper books have already been prepared or not.

The department is also further directed to file a report as to

whether any other appeals have been preferred in connection

with the judgment and order impugned in the present appeal.

Let such report be produced on the returnable date.

Mr. Ghosh, learned advocate appears for the State.

List this matter for further consideration on 9th August,

2021.
