In Re : An application under Section 482 of the Code of Criminal Procedure.
The revisional application has been preferred
against the judgment and order dated 16.11.2010 passed by
the learned Judicial Magistrate, 1st Court, Jangipur,
Murshidabad in M. R. Case No. 76 of 2008(T. R. 962 of 2008)
under Section 125 of the Code of Criminal Procedure.
The learned Magistrate by the said judgement and
order was pleased to allow the application under Section 125
of the Code of Criminal Procedure in part and directed the
husband to pay Rs.1500/- per month to the wife and
Rs.1000/- per month to the minor daughter as maintenance.
Record reveals that the learned Magistrate on an
appreciation of evidence and in presence of both the parties
was pleased to arrive at such conclusion.
Having regard to the reasons which were assigned by
the learned Magistrate and was considered after scrutinizing
the same, I am of the view that at this belated stage there is no
scope for interference in the impugned judgement and order.
Accordingly, the present revisional application being
CRR 2841 of 2011 is dismissed.
All pending applications, if any, are consequently
disposed of.
Interim order, if any, is hereby vacated.
All parties are to act on the server copy of this order
duly downloaded from the official website of this court.
