In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in sg connection with Kalyani Police Station Case No. 675 of 2016 dated 28.11.2016 under Sections 341/326/307/120B/34 of the Indian Penal Code read with Sections 25/27 of the Arms Act.
Babu Roy @ Bapi Roy Versus The State of West Bengal
Mr. Sanjib Mitra, Adv.
...for the Petitioner.
Mr. Madhusudan Sur, Adv.
Mr. Dipankar Paramanick, Adv.
...for the State.
The learned Counsel for the petitioner in his usual fairness has submitted
that the petitioner has made a prayer for renewal of his bail. The petitioner is in
custody for four years and four months.
We find from the records that earlier the applications were rejected with a
direction upon the learned trial court to conclude the trial within a specified period.
However, due to pandemic situation, the trial could not progress on a regular basis.
Considering the fact that eight witnesses out of 12 witnesses have been
examined in the meantime and 26th April, 2021 has been fixed for examination of
the remaining witnesses, we request the learned trial court to prepare a schedule for
examination of the witnesses and thereafter fixed for argument so as to deliver the
judgment preferably within a period of six months from the next date fixed without
granting unnecessary adjournments to either of the parties.
Accordingly, the prayer for bail is rejected.
All parties shall act on the server copy of the order.
