1. Heard the learned Advocate Mr.Nikat h/f Mr.Karpe, the

learned APP Mr.Narwade for the Respondent/State and the learned

Advocate Mr.Tambe, for the Informant.

2. These proceeding have been heard on earlier occasions. An

order dated 7 August 2025 has been passed where the Court had placed

the matter for further consideration on 12 August 2025, which was

then placed on 14 August 2025 i.e. today for hearing at 2.30 PM.

Today when the matter was called out, the learned Advocate Mr.Nikat

submits that the learned Advocate Mr.Karpe for the Applicant has filed

a leave note.

3. In the meantime, the learned Advocates for the respective

parties may peruse the judgment of the Supreme Court in the case of

Niranjan Singh and Another Vs. Prabhakar Rajaram Kharote and others

[AIR 1980 SC 785], which may have some bearing on the present

proceedings.

4. Mr.Tambe has also circulated an order of the Supreme

Court dated 7 October 2020 passed in SLP (Cri.) No.3959/2020 in the

case of Vinod Kumar Sharma and another Vs. the State of Uttar Pradesh

and Another. The subsequent order is already on record. A copy of the

same has also been furnished to the learned Advocate for the Applicant.

5. Considering the above, place this Application for further

consideration on 22 August 2025 at 2.30 p.m. Needless to observe that

it may be taken up for further consideration / hearing by the Court

subject to the availability of time and cause list on that day.
