2. A Look Out Circular was issued against the applicant at the behest of respondent No.1- Bank of Baroda. This Court by order dated 23 rd April 2024 passed in Writ Petition No.719 of 2020 along with connected matters, including Writ Petition No. 621 of 2022 preferred by the applicant-petitioner, has quashed the Look Out Circular issued against the applicant-petitioner. It is common ground that the judgment of this Court dated 23rd April 2024 in Writ Petition No.719 of 2020, along with connected matters, is the subject matter of challenge before the Supreme Court in Special Leave Petition

Nos.17194-17230 of 2024 (Union of India and Ors. Vs. Viraj Chetan Shah and Ors.). In view of the order dated 12 th August 2024, the present interim application has been moved seeking leave to travel abroad.

3. It is submitted that previously also the applicant travelled outside India for his business purpose without any hindrance and returned back to India within the permitted time. It is submitted that the applicant has to travel abroad for business purpose only. In support of his submissions, the learned counsel placed on record copies of the orders passed by this Court, which are annexed as Exhibit-A, Exhibit-B, Exhibit-C and Exhibit-D to the petition.

For the reasons mentioned in the application and having regard to the facts that earlier the applicant was allowed to travel abroad and has duly returned back to India complying with the conditions imposed, the applicant can be permitted to travel abroad for three months from today. Hence, the Application is allowed on the following terms and conditions: -

(a) The applicant shall file an undertaking in this Court setting out a detailed itinerary of the above travel including the airline tickets, addresses of the hotels/residence where he would be staying during the above travel, along with other contact details. This undertaking shall also state that the applicant shall return to India on or before 17th November 2025.

(b) The applicant shall also file an undertaking stating that he would not apply for renewal and/or extension of this order until he returns back to India.

(c) Both the aforesaid undertakings shall be served on the Advocates for respondent No.1 - Bank of Baroda before the date of departure.

(d) Within one week of returning to India, namely, within one week from 17th November 2025, the applicant shall file an affidavit setting out the expenses incurred by him during the above travel and the source/s of income used for funding the said expenses. This affidavit shall also be served on the Advocates for respondent No.1 - Bank of Baroda within a period of one week from 17th November 2025.

5. The applicant is permitted to travel from Mumbai to United Kingdom (i.e., London), Dubai, Singapore and Switzerland for a period of three months from 14 th August 2025 till 14th November 2025 on aforesaid conditions.

6. It is clarified that this order does not apply to any other Look Out Circular and/or restrain order, if issued by any other Authority / Court / Agency / Bank.

7. The immigration authorities at all ports of departure including all airports will permit the applicant passage and permit the applicant to take his flights out of the country.

8. The immigration authorities shall not insist upon a certified copy of this order but will act on presentation of an authenticated or digitally signed copy of this order.

9. The Interim application is disposed of in the above terms.

10. List for reporting compliance on 24th November 2025.
