PER COURT :-

1. Learned advocate for the applicant prays for time to amend

the prayer clause as ordered by this court on 10.1.2024. Learned

advocate for the applicant submitted that the applicant is ready to pay

50% of the amount out of arrears of maintenance amount, in the

Family Court at Latur.

2. Subject to deposit of 50% of the maintenance amount in

the Family Court, Latur, there shall be stay to the execution of the

Judgment and order dated 25.04.2023, passed by the Family Court,

Latur, in petition E-13 of 2022.

3. It is clarified that the applicant shall continue to deposit the

50% amount of maintenance in the Family Court regularly. If the said

amount is not deposited, the trial court/executing court shall proceed

further without reference to this Court.

4. It is also clarified that as per clause 3 of the final order

dated 25.4.2023, if the respondent is receiving amount of rent of the

house, gifted to her, the same shall be considered on the basis of the

evidence while executing the said award.
