1. Arguable questions are raised. Hence, Rule.

2. The questions which arise for consideration is, whether a person claiming to be son of deceased Trustee can be termed as either Trustee or beneficiary in view of the language of the trust deed and whether at his instance the revision under Section 70A of the Maharashtra Public Trusts Act, 1950 could have been entertained by the Charity Commissioner.

3. According to the petitioner, the judgment in the case of Maganlal Himatram Barfiwala and Others Vs. Mridangraj Hiralal

Suchak, reported in 2019 SCC OnLine Bom 336 covers the issue.

4. Hence, there shall be interim relief in terms of prayer clause

(c).

5. Learned Senior Advocate for petitioners states that, he has instructions not to press for interim relief in terms of prayer clause

(d) in this petition and to raise such relief in appropriate proceeding. Liberty as prayed is granted.
