Shri Kukday, learned counsel for the applicant/appellant, by tendering pursis dated 19.08.2024 across the bar accompanied by the judgment in Claim Petition No.535/2016 dated 04.07.2023, which is taken on record, submits that in the claim petition, which is decided on merits, the appellant has been exonerated from liability, therefore, the present appeal filed against the order of liability becomes infructuous.
2. In view of above, the civil application as well as first appeal stand disposed of as infructuous. No costs.
