PER COURT : -

1. Mr. Shambhuraje Deshmukh, learned advocate for the

Applicants submits that, this Court had, on 14 th February, 2023, passed

the following order in connected matter i.e. Civil Application No. 1917

of 2023, which reads thus : -

"1. Issue notice to the respondents. Learned AGP waives notice for respondent No.2. Notice of respondent No.1 is made returnable on 20.03.2023.

2. Till the next date there shall be stay to the impugned Judgment passed by the Reference Court i.e. 10th Joint Civil Judge Senior Division, Aurangabad on 13.06.2022 in Land Acquisition Reference No.79/2013, subject to deposit of 70% of amount of compensation i.e. the compensation granted plus interest, which is to be

3. It is clarified that if the amount is not so deposited, it shall be treated that there is no stay."

2. In view of the above, issue notice to the respondents,

returnable on 14th November, 2024. Learned AGP waives service of

notice for State.

3. Till the next date there shall be stay to the impugned

Judgment passed by the Reference Court i.e. 10 th Joint Civil Judge

Senior Division, Aurangabad on 13.06.2022 in Land Acquisition

Reference No. 79/2013, subject to deposit of 70% of the amount of

compensation i.e. the compensation granted plus interest, which is to be

deposited within twelve (12) weeks.
