Heard learned Advocates for the parties. Perused the record and proceedings.

2. This is an application for stay to the execution of the impugned judgment and award dated 18.07.2006 passed by the Arbitrator and confirmed by the learned Principal District Judge, Nagpur vide judgment and award dated 11.04.2022. Learned Advocate for the appellants submits that the appellants are ready to deposit the decreetal amount with interest as on the date of the deposit.

3. Learned Advocate for the respondent No.1 submits that subject to deposit of decreetal amount with 2 4.CAM.6.2023.odt

interest as on the date of the deposit and permission to respondent No.1 to withdraw the said amount, the stay may be granted.

4. In view of this, the application is allowed.

5. There shall be stay to the execution of judgment and award dated 18.07.2006 passed by the Arbitrator and confirmed by the Principal District Judge, Nagpur vide judgment and award dated 11.04.2022 , till final disposal of this appeal, subject to deposit of the decreetal amount within eight weeks with interest as on the date of deposit

6. Liberty is granted to respondent No.1 to withdraw the decreetal amount with interest, as & when deposited.

7. The civil application stands disposed of, accordingly.
