1. Learned Counsel for the applicant, seeks leave to amend the
application to implead Assistant Collector/Commissioner of
Customs as party respondent No.3.
2. Leave granted. Amendment to be carried out forthwith.
3. After carrying out amendment, issue notice to the respondents
returnable on 5th December, 2023.

4. Learned A.P.P waives service on behalf of respondent No.2-
State.
5. Liberty to the applicant to serve respondent No.1 and newly
added respondent by private notice.
6. Hamdast is granted.
7. Till the respondents are served, there shall be interim stay to
clause-5 of the impugned order passed by the Additional Sessions
Judge in the impugned judgment dated 30th September, 2023, which
reads thus;
"5. The Ld. Metropolitan Magistrate is directed to issue non-bailable warrant against accused, as he is absent today before this Court and execute and implement the judgment and order as per rules".
