Regular Civil Suit No.73/2008, (new No. 23/2012) came to be dismissed in default on 10/09/2014. An application for restoration filed on 24/09/14 have been dismissed by the trial Court by the judgment dated 24/1/2018 (page 56). Appeal against which has also been dismissed by the judgment dated 28/9/2020 (page 69). Considering the limitation prescribed, there does not appear to be any delay in filing the application. The same appears to have been rejected on the ground that there were directions by this Court to decide the suit.

2. Issue notice for final disposal on 06th March, 2023.

3. The petitioners shall serve the respondents by all modes permissible in law. Hamdast granted.
