1. When the matter is called out, Mr. Doshi, learned Counsel for the

Plaintiff appears and submits that the Advocate for the Defendant has

intimated to them that they are in the process of taking discharge in the

matter. Learned Counsel would submit that despite a number of emails

and also physical notice to the Defendant, none appears for the

Defendant today and none appeared for the Defendant even on 31 st

October, 2023. Learned Counsel submits that pleadings are complete in

the matter and therefore this Court proceed to hear the matter.

2. Be that as it may, issue notice to the Defendant, returnable on

15th January, 2024. Private notice by any legitimate mode, including

digital mode, is permitted. Let the affidavit of service with tangible

proof be filed by the next date.
