1. Mr.Thorat, learned Counsel, appears for the Plaintiff and submits

that despite notice to the Defendants to appear in the matter, none

appears for the Defendants even today. Learned Counsel submits that

there was in Interim Application filed on behalf of the Defendants

seeking condonation of delay in filing leave to defend. However, once

again, none appears for the Insolvent / Interim Applicant.

2. Learned Counsel submits that the Affidavit of Evidence along

with compilation of documents has already been filed online and seeks

to tender physical copy of the same.

3. Learned Counsel requests this Court to take up the matter for ex-

parte decree.

4. Accordingly, list for ex-parte decree on 17th January 2024.
