1. Issue notice for final disposal to the respondents, returnable on 13 February 2024.

2. Prima facie it appears that the suit is not maintainable in view of the judgment of the Apex Court in Pushpa Devi Bhagat v. Rajinder Singh reported in (2006) 5 SCC 566. Prima facie it appears that the remedy of a person aggrieved challenging consent terms on the ground of collusion or fraud is to approach same Court immediately by way of an independent application.

3. Hence, there shall be ad-interim relief in terms of prayer clause (B) till 13 February 2024.
