1. This matter has been listed at 12:30 p.m. for hearing of the

summons for judgment. When matter is called out, Mr.Arjun

Kadam, learned Counsel for the defendant No.1 would submit that

although they have received copy of the audit report, however, the

same is without annexures and the plaintiff be directed to furnish

the annexures. Learned Counsel for the Defendant would also

submit that the report of the handwriting expert has also not been

furnished and that the same also be furnished to the Defendants.

2. Mr.Anoshak Daver, learned Counsel for the plaintiff would

submit that while he has no objection in providing the defendants

copy of the annexures to the audit report and the report of the

handwriting expert, however, he states on instructions that these

documents only form an internal record to confirm the suspicions

and do not form the basis of the suit.

3. Accordingly, let the annexures to the audit report as well as

the report of handwriting expert be furnished to the defendants

within a period of one week from today. Let the defendants take

instructions within a period of one week thereafter.

4. List on 11th September, 2023 at 02:30 p.m.
