CORAM: S. V. GANGAPURWALA, ACTING C. J.

                                                  DATE: APRIL 13, 2023,
                                                           IN CHAMBERS AT 5.30 P.M.

                         P.C.:

1. Ms. Talekar, learned advocate for the applicants submits that the applicants are residents of Nashik District and are in Government employment at Nashik. Considering the means of conveyance, it is not possible for them to travel to Aurangabad every now and then so as to give instructions to their advocate. It has become difficult and onerous for the applicants to prosecute the proceedings at Aurangabad Bench. In view of that, the matters be transferred to the Principal Seat at Mumbai.

1-MCA.53.2020

2. I have also heard the learned AGP.

3. The Nagpur seat is at equidistance from Aurangabad and Mumbai. The judgment of the Scrutiny Committee is assailed. The jurisdiction would be Aurangabad Bench. The matters are rightly filed before Aurangabad Bench. The difficulty expressed of travelling to Aurangabad would also be the same for travelling to Mumbai.

4. In light of that, I am not inclined to consider the request of the applicants. The applications are disposed of.

(ACTING CHIEF JUSTICE)
