3. In this batch of petitions the grievances have been made
regarding the transfer of Zilla Parishads teachers. The petitioners claim that
the transfers have been effected de hor of the Transfer Policy framed by the
State Government.
4. Before proceeding to deal with the grievance of the petitioners in
this batch of petitions, we would first advert to the Transfer Policy framed
by the State Government.
5. With intent to bring more transparency in the process of intra-
district transfer of the teachers of Zilla Parishad Schools and to provide
equal opportunities to the teachers working in difficult areas and to transfer
the teachers in the difficult areas and plain areas, alternatively, the State
Government vide Government Resolution dated 27/02/2017 for the first
time came with a comprehensive policy of intra-district transfer of teachers
of zilla parishad schools with the help of a software. Due to pandemic
situation in the entire country, the said policy could not be implemented for
couple of years. Meanwhile, transfer policy was also amended from time to
time and by Government Resolution dated 07/04/2021 (hereinafter
referred to 'said GR'), the State Government issued modified Transfer
policy. Thereafter, by couple of Government Resolutions in the form of
clarification/amendment, the said policy was also corrected. The highlights
of the modified Transfer Policy are as under:

(1) In the first place, the teachers who have completed 10 years or more continuous service in plain area and have completed 5 years of service in the present school are stated as 'liable to be transferred'.
(2) For counting the length of service and for other purposes cut-off date was fixed as 30/06/2022.
(3) Each teacher shall give Choice of 30 places in order of preference to be transferred,
(4) The exception has been made for the teachers who come in category-1 having any of the ailments/contingencies mentioned in clauses 8.1.1. to 8.1.20 including the teachers who have completed 53 years of their age on the cut-off date. The teachers come under this category either may request for their retention at present posting or can seek the transfer from the present posting irrespective of the fact where they are liable to be transferred or not.
(5) Likewise, a provision is also made for the teachers whose spouse are government employee or teacher in zilla parishad, for providing couple benefit. They are categorized as category-2 with an option to seek transfer within 30 kilo meters radius from the school/office of the spouse.
(6) A special category is also created for the teachers who have completed 3 years or more in difficult area. They can seek the transfer if they desire irrespective of the fact that they are not liable to be transferred or otherwise.
(7) While effecting transfer, the teachers who come in category-1 will be accommodated first, thereafter attempt shall be made to see

that the teachers who comes in category-2 can be accommodated near the place of working of his/her spouse. In order third, the teachers who are entitled to be transferred under Special Category will be taken care of, and lastly, the remaining teachers, who are liable to be transferred, will be transfer, as far as possible, at the places of their choice in order of their preference out of 30.
(8) After this effecting above said process, if the seats in difficult areas are remained vacant, as perClause 1.10 of the Transfer Police the teachers, who have completed 10 years of their continuous service or more, irrespective of completion of 5 years' service in the present school will be given option to fill their choice of available vacant seats in order of preference and accordingly, the transfer will be done of those teachers.
6. This takes us to the grievances made by the petitioners in this
batch of petitions, who are considered in last step of the transfer mentioned
above in clause 8. For convenient purpose, instead of going to the
grievance qua teachers, we have categorized the grievances of the teachers
broadly in following categories.
Grievance-1: The grievance of most of the petitioners/teachers in
this batch of petitions comes under this category. Some of the petitioners
have ailments. Some of them have already completed 53 years of their age
on cut of date. The most of the petitioners have raised a grievance that even
though, initially their names were not finding place in the list of the teachers
liable for transfer, in last round most of these petitioners, who have

completed their age of 53 years during the intervening period of
30/06/2022 till the last round of transfer process, have been transferred.
According to them, since they have completed the age of 53 years or
suffering from ailments, they come under category-1 and to exercise the
option for retention was not made available to them.
Grievance-2: Some of the petitioners have been posted in difficult
area and again they are transferred to the other difficult area. According to
these petitioners, they had already worked in the difficult area and again
they have been transferred in another difficult area.
Grievance-3: The petitioners raised grievance that they have not
completed 3 years in difficult area still they are transferred.
Grievance-4: The grievance of this category is that though they
have not completed 10 years in plain area which is mandatory requirement,
still they have transferred in this process.
Grievance-5: The some of the petitioners, who were eligible for
couple benefit and are required to be placed within 30 kilo meters radius of
the places where their spouses were working, have been transferred beyond
30 kilo meters of radius of the places where their spouses are working.
Some of the petitioners have not been considered for the couple benefit,
since they have not completed 3 years of service. Some of the petitioners are
not given option for taking benefit of couple transfers,

Grievance-6: The petitioners in who were taken up for transfer in
last phase were not given choice of 30 places which were given to the
teacher who were transferred in initial process.
Grievance-7: While effecting transfers to the teachers in difficult
area, the seniority has not been considered.
7. We have heard the learned counsel appearing for the petitioners,
learned counsel appearing for the respective zilla parishads as well as the
learned Assistant Government Pleaders appearing on behalf of the State
Government.
8. It is contended on behalf of the learned counsel appearing for
the petitioners that the transfer policy has not been followed in letter and
spirit and abruptly, in last round the teachers, who were not eligible for
transferred have been transferred. Even the teachers i.e. who have
completed 53 years of age on the date of last round, have been transferred.
It is also contended that these petitioners who have been abruptly put in
the process of last phase of the transfer process have not been given any
option to exercise the benefit of category-1 and 2. Without considering
their difficulty, most of the petitioners have crossed their age of 53 between
30/06/2022 have been shown transferred in the last phase of transfer.
Even, while effecting transfer of the teachers in category-2, the norms in
the transfer policy has not been followed.

9. Per contra, learned Assistant Government Pleader appearing on
behalf of the State Government vehemently submits that in the wake of
Right to Education Act, 2007, and to give equal opportunity to the teachers,
who are posted in difficult areas, a comprehensive policy of transfer has
been brought into force in the year 2017, which was challenged before this
Court at Principal Seat in the case of Maharashtra Rajya Shikshan Seva,
Basmat and another v. State of Maharashtra and others , reported in 2018
(1) Mh.L.J. 388, wherein the Division Bench of this Court while dismissing
the petition, held the transfer policy prepared by the State Government to
be valid.
10. It is also contended due to COVID-19 and other administrative
difficulties the effect could not be given to the said transfer policy. Now the
government with slide modification in the said transfer policy by way of
government resolution dated 07/04/2021, the present transfers of teachers
of zilla parishads through out the State of Maharashtra have been
implemented. All these petitioners, who are claiming to be abruptly
transferred in this last round are liable to be transferred as per clause 1.10
of the said GR, since they have completed 10 years of their continuous
service. It was provided in the said GR that if the seats remain vacant in
difficult areas, these teachers will be considered for transfer. It is
contended that the relief was already provided to the teachers, who comes
in category-1 by providing option tab for their willingness to either
participate in the transfer process or not in the wake of the order in Writ

11. The learned counsel appearing for the respective zilla parishads
vehemently submit that all care has been taken in the last round of the
transfer process where the seats were still lying vacant in the difficult areas
and the teachers who have completed 10 years have been due for transfer.
Even the options for places, out of vacant seats, were available to the
teachers who are transferred in last phase. Most of the petitioner have
exercised the options. According to them, the mechanism has been
provided in the transfer policy itself. Without exercising that option, the
petitioners have directly approached to this Court. It is contended that
there is efficacious alternate remedy available to the petitioners, which they
did not exercise before approaching this Court. Therefore, all the petitions
are required to be dismissed.
12. This takes us to later part of Clause No.1.10 of the Transfer
Policy, if the seats remained vacant, those seats will be filled up by the
teachers who have completed 10 years of the service, irrespective of the
completion of 5 years in the present school. In wake of this clause, the
grievance of the petitioners that their names were not shown in the initial
process of the transfer and despite they had not completed 5 years in the
present school and were abruptly shown transferred in the last round, does
not hold water.

13. So far as grievance regarding completion of 53 years of age by
the teachers during intervening period is concerned, the transfer policy
provides the cut-off date for considering the age as 30/06/2022. Age of all
the teachers, who have been transferred in initial process of the transfer i.e.
the teaches, who have completed 10 years or more of their continuous
service and 5 years of service at present school, have been assessed on basis
of the cut-off date i.e. 30/06/2022. Needless to mention, it is the last
round of the same process, the same date must be considered as a cut-off
date for the petitioners. Though, they might have completed their age of 53
years between cut-off date i.e. 30/06/2022 and on the date of publishing
their transfer list, fact remains that on the cut-off date, they were below 53
years as in case of the teachers, who have been transferred in initial stage
of process. Being the same transfer process, the same cut off date was
considered for the teachers who are transfer in initial stage and subsequent
stage of the same transfer process. If this ground of teachers who have been
transferred in the second phase of transfer process is considered, it will be,
as good as, opening a flood gate of grievances/litigations even by the
teachers, who have been transferred in initial phase/stage of the transfer
process.
14. Notably, at each stage of the transfer policy, an option is
provided to raise an objection for correction in the list of teachers of
category 1, 2, 3 and 4. Even after completion of the process of transfer, an
option has been given to teachers raise to any grievance against any

irregularity or illegality in the transfer before a Committee constituted at
district level consisting of Chief Executive Officers, Deputy Chief Officer
(General Administration Department) and Education Officers (Primary) of
respective zilla parishads, more particularly referred in clause 5.10.1 of the
said GR. Above all, an appeal has also been provided before Divisional
Commissioner, if any teacher is not satisfied with the decision of the
Committee.
15. Every care has been taken in the Transfer Policy by providing
entire mechanism to redress the grievances not only at each stage of the
transfer process, even after the completion of transfer process, an option
has been given to the teachers to raise their grievance by making complaint
or representation to Committee. Further, if teacher is not satisfied with the
outcome of the said complaint by the Grievance Committee, an appeal has
been provided before the Divisional Commissioner of the respective areas.
16. The transfer of teachers is always a matter which have many
aspects and manners and required individual adjustment in some cases.
The mechanism provided by the Transfer policy to resolve the grievances is
more suitable for the teachers than approaching to this Court, having
persons/Authorities in the Committee, who have knowledge of ground
realities and aware of the day to day problems of the teachers. Thus, we
find that there is efficacious alternate remedy available to the petitioners to
take care of the grievances raised by these petitioners in this batch of

petitions.
17. We noticed that similar grievances have been made before this
Court against the transfer orders in earlier transfer processes in Writ
Petition Nos.3453 of 2011, 3236 and 2846 of 2013. In all these writ
petitions, the petitioners, who were teachers, were relegated to exercise
alternate remedy before the Committee/Authority.
18. We are conscious of the fact that most of the petitioners
approached this Court without availing this remedy and while doing so the
period of raising grievance might have already been over. Therefore, we
relegate the petitioners to the Committee constituted under Clause 5.10.1
of the Transfer Policy to raise their grievances to the respective Grievance
Committee within seven (7) days from the date of this order.
19. We direct the committees of the respective Zilla Parishads, who
are parties in this batch of petitions shall accept the representations from
the petitioner, if so made within permitted time. The Committee provided
by Clause 5.10.1 of Transfer Policy to consider the grievances/irregularity
raised by the petitioners independently without being influenced by the
observations made by this Court and if the Committee finds any irregularity
or illegality, it should rectify the same, if necessary. We direct the
Grievance Committee concerned to pass a reasoned order after classifying
teacher's vis-a-vis their grievances. If the petitioners are not satisfied with

the orders of the Committee, they may exercise the option of appeal
available to them under clause 5.10.2 within seven (7) days from the date
of the order of the Committee.
20. We hope that the Committee will resolve the grievances of the
petitioners/teachers as far as possible giving human approach and within
the framework of Transfer Policy.
21. With these observations, the petitions are disposed of.
22. Rule accordingly. No costs.
23. In view of disposal of writ petitions, the pending application(s),
if any, is(are) disposed of.
