The petitioner seeks benefit of grant of time bound promotion under the Assured Career Progression Scheme on completion of 12 years service. In that regard, the petitioner has relied upon the judgment of the learned Single Member of the Maharashtra Administrative Tribunal in Original Application No.166/2016 taking the similar view. However, while considering the original application of the petitioner, the learned Member despite referring to the aforesaid decision, has held that the petitioner would be entitled to claim such benefit from the date he clears the relevant departmental examination. The application for review preferred by the petitioner has also been rejected. It is urged that the learned Member deciding the original application preferred by the petitioner ought to have referred the matter to the Division Bench considering his disagreement with the order passed in Original Application No.166/2016.

Issue notice to the respondents, returnable in three weeks.

The learned Assistant Government Pleader waives service of notice for the respondents.
