Leave granted to add pages to the writ petition. The petitioner who seeks appointment as Constable with the Central Armed Police Forces has been found to be unfit on the ground that there is a tattoo on his right forearm.

The learned counsel for the petitioner submits that the said tattoo has now been removed and what remained is only a scar. He seeks to rely upon the judgment of Delhi High Court in Writ Petition (C) No.15302/2022 (Shubham Sharma vs. Union of India and ors.) dated 09/11/2022 to urge that in somewhat similar circumstances the petitioner therein was directed to be again examined by the Medical Board.

Issue notice, returnable on 06/12/2022. Shri N. S. Deshpande, learned ASGI waives notice for respondent Nos.1, 3 and 4. In addition, service on respondent No.2 by speed-post is permitted.

In the meanwhile, one post in the Maharashtra-General-Unreserved- Male category for the post of Constable (GD) in Central Armed Police Forces (CAPFs), NIA, SSF and Rifleman (GD) in Assam Rifles Examination- 2021 shall be kept vacant.
