2. Impugned in the petition is an order passed below Exhibit-16

on 04/01/2018 by Small Causes Court, Bombay whereby the

prayer of the petitioners/respondents to the aforesaid appeal

before the Appellate Bench of the Small Causes Court for dismissal

of the suit, came to be rejected.

3. My attention is invited to the judgment delivered by the

Appellate Court of Small Causes Court in appeal no. 18 of 2013 on

04/05/2019 whereby respondents appeal was dismissed.

4. As the order impugned which is passed in the appeal being

appeal no. 18 of 2013 is already dismissed, the subject matter in

the petition has rendered infructuous.

5. The petition, as such, stands disposed of.

6. In view of disposal of petition, the civil application does not

survives and also stands disposed of.
