appellant.

2. This is an application for condonation of delay in filing the

second appeal against the judgment and order passed in Regular Civil

Appeal no. 20 of 2004.

3. Though she is complaining about having been excluded

from receiving any share, she was the defendant no. 8 before the trial

court which did not allot any share to her. Apparently, she did not

chose to file any appeal or even a cross-objection in her capacity as

respondent no. 5 before the lower appellate court.

4. Having pointed out the afore-mentioned facts, the learned

advocate Mr. Ashtekar seeks time to take instructions.
