1 Heard the learned APP appearing for the Respondent/State.

2 The Petitioner has filed his application addressed to the Hon'ble

the Chief Justice of this High Court wherein he prays for his transfer from

Nashik Road Central Prison, Nashik, to Thane Central Prison, Thane. The

grievance made by the Petitioner is that on the relevant dates fixed by the Trial

Court in his pending Special MCOCA Case No.6/2011, he was not produced

before the Court due to non-availability of guard.

3 Since the said Special Case was registered in the year 2011 and

this Application has been filed by the Petitioner in the year 2017, in all

probability, the trial in said Special Case might have been completed. However,

in case, the trial in said Special Case is not yet complete, and the said case is

pending, we direct the Special MCOCA Court, trying the Special Case

No.6/2011, to expedite the trial of the said case and take it to its logical end

including pronouncement of judgment as expeditiously as possible however

within a period of one year from the receipt of the copy of this order.

4 Needless to observe that, the parties shall extend full co-operation

for early disposal of the said special case.

5 With the above directions, the Writ Petition stands disposed of.

6 The Registry shall send a copy of this order to the concerned

competent authorities who in turn shall communicate the same to the

Petitioner.
