Heard learned advocate for the appellant/original plaintiff.
There is delay of 66 days in preferring the Second Appeal. The learned trial Court decreed the suit of the plaintiff, whereas it was reversed by the First Appellate Court that is how the plaintiff wants to file Second Appeal. On account of his sickness and sickness of his son, the appeal could not be preferred in time.
The judgment by the First Appellate Court was delivered on 03.08.2019. The copies of medical certificate are annexed. In spite of receipt of notice, the respondents/ original defendants are not appeared. The delay is satisfactorily explained. Hence, the delay is condoned. Civil Application is disposed of.
