                         .                        The essential challenge in the petition is to the

validity of Section 6(1) of the Maharashtra Scheduled Castes, Scheduled Tribes, Denotified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of Issuance and Verification of) Caste Certificate Act, 2000 mainly on the ground that essential judicial function cannot be delegated.

2. Prima facie and subject to hearing petitioner, it appears that the issue involved in the present petition is covered by the judgment of the Hon'ble Apex Court in the case of District Collector, Satara and Anr. Vs. Mangesh Nivrutti Kashid reported in (2019) 10 SCC 166. It is also necessary to consider the said challenge in the light of Rai Sahib Ram Jawaya Kapur and Ors. Vs. The State of Punjab reported in AIR 1955 SC 549.

3. In view of the aforesaid, it is necessary to consider the challenge raised by the petitioner. Hence, issue notice to the respondents, returnable after four weeks.

4. Ms K. R. Deshpande, learned A.G.P. waives notice for all the respondents.
