1. According to the petitioner, respondent No.2 has issued a work completion certificate in which it has been stated that the petitioner is entitled to an amount of Rs.1,89,42,536/-. Out of that amount, it is the case of the petitioner that Rs.1,31,36,987/- have been received. The balance amount which is admitted by respondent No.2 in the completion certificate is not being released despite various representations. The petitioner seeks to rely upon the judgment of the Division Bench of this Court in Writ Petition No.295 of 2017 (Century Textiles and Industries Limited and ors vs. The Municipal Corporation of Greater Mumbai and ors ) decided on 14.3.2022 to invoke jurisdiction of the Court.

2. Issue notice to the respondents, returnable in four weeks.

3. Shri N.R.Patil, learned Assistant Government Pleader waives notice for respondent No.1.

4. In the meanwhile, it is open for the respondent No.2 to consider the legal notice issued by the petitioner on 30.7.2021 and take necessary steps, if so advised.
