ORAL JUDGMENT : (Per : V.M.DESHPANDE, J.)

1. Rule. Rule is made returnable forthwith. Heard finally

by consent of the parties.

2. By filing this Writ Petition, the petitioner challenges the

order dated 15/06/2020, passed by the Superintendent of Open

Prison, Morshi, District Amravati in not granting furlough leave.

3. The reply would show that the furlough leave of the

present petitioner was granted on 27/11/2020 by the authorities. He

availed the furlough leave and he reported on due date i.e. on 2 26-wp-651-2020-J.odt

26/12/2020 to the Prison. The reply further states that the petitioner

was again on 26/12/2020 applied for emergency parole leave and in

view of the Government policy, the petitioner was released on

emergency parole leave on 26/12/2020. The reply states that the

parole leave of the present petitioner is extended from time to time

and even today the petitioner is on parole leave.

4. In view of this, nothing survives in this Writ Petition. The

Writ petition is disposed of.

5. Mr. K.C. Deogade, learned counsel appointed to

represent the petitioner is entitled to his professional charges from

the Legal Aid Committee and we quantified it as Rs.2500/- (Rs. Two

Thousand Five Hundred).

6. Rule accordingly. No costs.
